ok i tried this as well as installing again the zip both times i get this message:
Warning: ftp_mkdir() [function.ftp-mkdir]: Can't create directory: File exists in /home/****/public_html/Joomla.Start.php on line 322
then it says upgrade completed click here to finish and just get brought back to my front page with no installer

OK, the ftp_mkdir warning message is normal since it's an upgrade, JoomlaStart lets you know that the directory it tried to create already was created, that won't affect the upgarde process!
Second, on an upgrade you won't get an installation screen, try to login in your backend and see what version your site curently has!

ok well i guess it worked then
really really wonderful addition to joomla, if it was commercial id buy because you just gave me hours and hours of my time back (4 sites and counting!)

We will keep our Joomla install and upgrades tools free, however we do offer a full backup and restore product(JoomlaCloner) for purchase which includes an advanced tool for doing those tasks and also full support from our team!
